
Terms & Conditions
These terms and conditions apply to the Technium Challenge competition ("Technium Challenge"). By entering Technium Challenge, entrants agree to be bound by these terms and conditions and warrant that they have the legal capacity to be bound by the same.
1. Technium Challenge is organised by Technium, a part of the Welsh Assembly Government of Cathays Park,
2. Only companies qualified by Technium will be eligible to enter Technium Challenge.
3. All entrants must submit an Executive Summary and Business Plan (as described in the Competition Programme section of Technium’s website at the website address www.technium.co.uk/challengeuk ) by the given deadlines provided by Technium Challenge.
4. Decisions made by the judging panel are final and no correspondence regarding the judging of entries or any other matters relating to these terms and conditions can be entered into.
5. The entrant(s) will have either (i) been established and trading for less than 24 months, or (ii) the intention to commence trading within the next 12 months.
6. The entrant(s) anticipate achieving a turnover in excess of £1 million within the first five years.
7. Entrants must have some form of technological aspect or application to its product/service offering.

Technium will use an entrant's personal information for the purposes of Technium Challenge (including, without limitation, the purposes set out in paragraph 8 above) and for monitoring and statistical purposes. Technium may disclose such personal information to its service providers and agents for these purposes. Except where Technium is required by law (including European Union law) to disclose an entrant's personal information, Technium will only pass such information to third parties (other than its service providers and agents) with the relevant entrant's consent. Entrants have a right of access to the information Technium holds on them for which Technium may charge a small fee. Entrants also have a right to correct any inaccuracies in their personal information. By submitting an entry, entrants consent to Technium holding and using their personal information in accordance with these terms and conditions. Technium is a part of the Welsh Assembly Government which is registered with the Information Commissioner under number Z7107446.
10. Entrants are solely responsible for selecting the information to be disclosed as part of their Technium Challenge entry (including, but not limited to, any intellectual property rights or confidential information). Entrants warrant they have the authority to use any intellectual property comprised within their Technium Challenge entry and that no intellectual property or other rights of any third party will be infringed through the submission of such Technium Challenge entry. Entrants take sole responsibility for protecting their rights in any intellectual property to be disclosed as part of their Technium Challenge entry. Entrants are reminded that disclosure of any intellectual property in a submission without protection may compromise or invalidate those rights. For detailed advice, entrants should consult a specialist lawyer (or other appropriate professional). Entrants should limit so far as possible the disclosure of information which they consider to be confidential as part of their Technium Challenge entry. The Welsh Assembly Government and Technium are subject to certain disclosure obligations under legislation including, but not limited to, the Freedom of Information Act 2000, and as such, the Welsh Assembly Government and Technium cannot accept any obligations of confidentiality in relation to any Technium Challenge entry.
11. Unless stated otherwise, Technium accepts no responsibility for the return of any Technium Challenge entries. Technium accepts no responsibility for any unauthorised disclosure of any Technium Challenge entry and hereby excludes to the fullest extent permissible by law all and any liability for any such unauthorised disclosure.
12. Any money and/or services to be provided as prizes are non-transferable and must only be used and will only be paid or provided for the sole purpose of starting up and/or developing the business described in the Executive Summary and the Business Plan submitted by the entrants.
13. For the overall winner and two runners up to qualify for the discounted rental as part of the prize package they must have signed a residency agreement within a Technium centre. Technium reserves the right to enforce a time limit on this element of the prize package. Furthermore, the value of the rental discount must not exceed 50% of the total rental charges payable during their tenancy in a Technium centre.
14. Technium reserves the right at any time to alter prizes and/or support provided by sponsors as part of Technium Challenge.
15. Technium reserves the right to disqualify any entrant if it has reasonable grounds to believe that the entrant has breached any of these terms and conditions.
16. Entrants will be responsible for their own expenses and costs in preparing and completing the Executive Summaries and Business Plans and any other costs or expenses incurred by them. Technium will have no responsibility or liability in respect of any such expenses.
17. By submitting an entry to Technium Challenge entrants warrant that all information submitted by them is true, current and complete.
18. Technium reserves the right to change any of these terms and conditions or cancel Technium Challenge at any time without prior notice. Any changes will be posted within these terms and conditions. A copy of these terms and conditions can also be obtained by sending a stamped addressed envelope to the address specified in paragraph 20 below.
19. Proof of posting cannot be accepted as proof of delivery. Technium cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control.

21. Technium cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering Technium Challenge or as a result of any entrant accepting any prize awarded under the Technium Challenge. Technium is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to any Technium Challenge entrant’s or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials as part of the Technium Challenge. Nothing in these terms and conditions shall exclude Technium's liability for death or personal injury as a result of its negligence.
